Terms of Service

Terms of Service

Template — must be reviewed by a lawyer before launch. This document is a starting point, not legal advice.

These terms apply to your use of Flint ("the Service"), operated by Hivello Ltd ("we", "us"). By creating an account or using the Service you agree to them. If you use the Service for an organisation, you accept them on its behalf.

1. The Service

We provide on-demand GPU compute, storage and an inference API, reachable through our dashboard at https://flint.monster and our APIs. Features, regions, prices and available hardware may change. We'll give notice before changes that materially reduce what you've paid for.

2. Your account

  • You must give accurate details and keep your sign-in email, API keys and SSH keys secure. You're responsible for activity under your account and keys.
  • Team admins control who is on their team and what each member can do.
  • Tell us promptly at [email protected] if you think your account has been compromised.

3. Acceptable use

You must not use the Service to:

  • break the law, or store or distribute content that is illegal or infringes others' rights;
  • attack, scan or disrupt other systems or networks, including ours;
  • try to access other customers' instances, data or traffic, or interfere with their use of shared hardware;
  • send spam or run phishing, malware or fraud;
  • mine cryptocurrency or run proof-of-work, mining pool or mining proxy software of any kind;
  • run open proxies, open mail relays, open DNS resolvers or Tor exit nodes;
  • resell access to the Service without our written agreement;
  • circumvent usage limits, billing or security controls.

These rules include the acceptable use policies of the infrastructure providers we run on, which apply to your use of the Service.

We may suspend instances or accounts that breach this section, where reasonably necessary without prior notice, and will tell you why.

4. Billing

  • The Service is prepaid. Usage is charged against your balance at the prices shown in the dashboard when the usage happens.
  • Running GPUs are charged per minute at the hourly price shown, with a hold of 30 minutes' credit while they run; paused GPUs at the reduced rate shown; storage per GB per month; the inference API per token.
  • Payments are processed by Stripe. If you enable auto top-up, you authorise us to charge your saved payment method when your balance falls below your chosen threshold.
  • If your balance runs out, we may pause or stop your instances and API access until you top up.
  • Unused credit is not refundable except where required by law or stated below. If an instance fails to start, the launch charge is credited back to your balance.

5. Your data

  • You keep all rights to the data, code and models you put on the Service ("Your Content"). You give us only the rights needed to run the Service for you.
  • Data on an instance's own disk (/workspace) is deleted when the instance is terminated. Shared volumes are kept until you delete them or close your account.
  • You're responsible for backing up Your Content. We take reasonable care but do not guarantee against data loss.
  • Our handling of personal information is described in the Privacy Policy.

6. Availability and support

We aim to keep the Service available and to fix problems quickly, but it is provided without a specific uptime commitment unless we agree one in writing. Spot capacity may be slowed when other customers need the hardware, as described in the docs. Support is available at [email protected].

7. Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or end your access if you breach these terms, fail to pay, or if required by law. Where we end the Service without cause we'll give reasonable notice and refund unused credit.

8. Liability

To the extent permitted by law, the Service is provided "as is", and our total liability for any claim is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential loss, including lost profits or data. Nothing in these terms excludes rights you have under consumer law that cannot be excluded.

9. Changes to these terms

We may update these terms. We'll post the new version here and, for material changes, tell you by email or in the dashboard before they take effect.

10. Governing law

These terms are governed by the laws of the Netherlands, and disputes are subject to the courts there.
